Can I Get A Modification?

In short, yes. In Montana, courts have discretion whether to amend parenting plans and custody arrangements. Plans can be amended when there is a substantial change in the child’s circumstances after the initial plan was made. Courts consider amendments when these changes are shown to be in the best interest of the child or children.

What The Courts Consider

Just as with a initial parenting plan, for modifications the courts consider:

  • Whether the parents agree to the plan
  • If the child is 14 years old or older
  • How the child feels about the proposed change
  • How both parents feel bout the proposed change
  • The behaviors of the parents in regards to allowing visitation
  • How the new plan will affect both parent’s time with the child/ children

Parenting plans do not need to be modified for small changes that both parents agree to. However the initial plan submitted to the court is essentially the default parenting plan.
